Honey Bees 911 LLC (hereinafter Honey Bees 911) is proud to bring you trusted online software tools to help the general public effectively report honey bee swarms and connect with beekeepers to remove identified swarms. Our company offers an online software platform that provides unique networking solutions and resource tools to locate beekeepers in a specified area and collect data for researching honey bees.
PLEASE READ THIS INFORMATION CAREFULLY BEFORE BECOMING A MEMBER AND USING OUR HONEY BEES 911 PLATFORM. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH HEREIN. HONEY BEES 911 RESERVES THE RIGHT TO UPDATE AND MODIFY THIS AGREEMENT AT ANY TIME. YOUR ACCESS AND USE OF HONEY BEES 911 SHALL BE DEEMED YOUR AGREEMENT TO ACCEPT THE TERMS OF SERVICES.
  1. Use of our services:
    • By registering your organization and/or personal profile with Honey Bees 911, you permit Honey Bees 911 to store and manage all information in our database, and you recognize that all information/pictures/materials/data or any medium may be viewed by any another Honey Bees 911 user.
      • You are responsible for all information you provide Honey Bees 911, whether the information is for an organization or your personal account. You will be responsible for maintaining the accuracy of all information by providing timely updates when and as necessary within Honey Bees 911.
      • Honey Bees 911 will not be held liable for any errors, omissions, or loss of business that may result from your use of Honey Bees 911 account.
    • You shall permit Honey Bees 911 to list your profile information including, but not limited to, your name, picture, and any other submitted information, on our website www.HoneyBees911.com (and HoneyBee911.com), and Honey Bees 911 shall have the right to list your associated beekeeper organization on our website(s).
    • You understand that, except for information, products or services clearly identified as being supplied by Honey Bees 911, our company does not operate, control or endorse any information, products or services listed within our network unless they are specifically identified. In addition, products and services offered through Honey Bees 911 by third parties may not have a direct affiliation with Honey Bees 911.
    • You agree to NOT post, use, or transmit:
      • content that you do not have the right to post or use; for example, under intellectual property, confidentiality, privacy or other applicable laws.
      • unsolicited or unauthorized content, including advertising or promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of unsolicited or unwelcome solicitation or advertising.
      • content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or otherwise interfere with or disrupt Honey Bees 911 IT resources.
      • content that is harmful, offensive, obscene, abusive, invasive of privacy, defamatory, hateful or otherwise discriminatory, false and misleading, incites an illegal act, or is otherwise in breach of your obligations to any person or contrary to any applicable laws and regulations.
    • You also agree to NOT:
      • Use or attempt to use another's account, service, company, or personal information.
      • Remove, circumvent, disable, damage or otherwise interfere with any security- features or any other features.
      • Attempt to gain unauthorized access to Honey Bees 911 IT resources, other accounts, computer systems or networks connected to Honey Bees 911 IT resources, through hacking, password mining or any other means, or interfere or attempt to interfere with the proper working of Honey Bees 911 IT resources or any activities conducted through Honey Bees 911 IT resources.
      • Impersonate another person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
      • In addition, you may NOT (and may NOT authorize another party or person to):
        • frame or otherwise co-brand the Websites or Services (for example, by displaying a name, logo, trademark or other means of attribution of a third party that is reasonably likely to give the user the impression that that third party has the right to display, publish or distribute Company, Service, or Employee information); or,
        • use Honey Bees 911 in any manner that could disable, overburden, damage or impair the Honey Bees 911 Service, or interfere with any other party’s use of Honey Bees 911.
  2. Third Party Rights:
    • The provisions of paragraphs 1 (Use of the Service), and 5 (Indemnification) are for the benefit of Honey Bees 911 and its officers, directors, employees, agents, licensors, clients, and any third party information providers to Honey Bees 911. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.
    • Some of the links made available to you through our platform will allow you to leave Honey Bees 911 services. Be aware that the internet sites available through these links, and the material and content contained therein, are not under the control of Honey Bees 911. Therefore, Honey Bees 911 does not make any representation or warranty about these sites or the materials or information contained therein, and the fact that Honey Bees 911 has made these links available to you is not an endorsement or recommendation to you by Honey Bees 911. These links may be uploaded by our users, or Honey Bees 911 may provide these links only as a convenience to you.
  3. Limitation of Liability:
    • IN NO EVENT WILL Honey Bees 911 LLC BE LIABLE FOR:
      • ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, OR ANY INFORMATION, OR TRANSACTIONS PROVIDED ON THE SERVICE, OR DOWNLOADED FROM THE SERVICE, OR ANY DELAY OF SUCH INFORMATION OR SERVICE. EVEN IF HONEY BEES 911 LLC OR ITS AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR
      • ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SERVICE AND/OR MATERIALS OR INFORMATION DOWNLOADED THROUGH THE SERVICE. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, HONEY BEES 911 LLC LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW, OR
      • ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES, BUT NOT LIMITED TO PHYSICAL, PROPERTY, OR EMOTIONAL DAMAGES, INCURRED BY ANY BEEKEEPER (“SWARM RESCUER”) OR SWARM REPORTER.
  4. Security:
    • Honey Bees 911 shall have the right to monitor the account at any time, and shall at its sole discretion change your account number and/or password. Any account numbers, login or passwords used for Honey Bees 911 Connect are for individual use only. You will be responsible for the security of your account, login and password and shall be required to contact Honey Bees 911 immediately in the event that your account number, login or password is stolen, misused, or if its confidentiality is compromised.
    • You are prohibited from using any services or facilities provided, in connection with this site, to compromise security or tamper with system resources and/or accounts. The use or distribution of tools designed for compromising security (e.g., password guessing programs, cracking tools or network probing tools) is strictly prohibited. If you become involved in any violation of system security, Honey Bees 911 reserves the right to remove your Honey Bees 911 account, and release your details to other Honey Bees 911 users to assist them in resolving any potential security incidents that have resulted from a security breach. Honey Bees 911 reserves the right to investigate suspected violations of these Terms of Use.
  5. Indemnification
    • You agree to indemnify, defend and hold harmless Honey Bees 911, its officers, directors, employees, agents, licensors, and any third party information providers to Honey Bees 911 from and against all claims, losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.
    • Honey Bees 911 reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with Honey Bees 911 in asserting any available defenses.
    • Your company and its representatives agree to indemnify and hold harmless Honey Bees 911 from any perceived damages that may come upon your company for being listed with our services.
  6. Privacy Policy
    • To prevent unauthorized access, maintain data accuracy, and ensure the correct use of Honey Bees 911, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.   7. Copyright, Licenses and Idea Submissions
    • The entire contents of the Site are protected by international copyright and trademark laws. The owner of the copyrights and trademarks are Honey Bees 911 LLC, its affiliates and/or other third party licensors. YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR SOFTWARE.
    • You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices or any other information from the materials.
  8. Miscellaneous:
    • This Agreement shall all be governed and construed in accordance with the laws of the United States applicable to agreements made and to be performed in the United States. You agree that any legal action or proceeding between Honey Bees 911 and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in the United States. Any cause of action or claim you may have with respect to Honey Bees 911 services must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Honey Bees 911’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Honey Bees 911 may assign its rights and duties under this Agreement to any party at any time without notice to you.
    • Any rights not expressly granted herein are reserved.
  9. Termination:
    • Honey Bees 911 LLC, in its sole discretion, reserves the right to modify, delete, or remove your company account and any user accounts from our database without any warning or any particular reason, unless your company has executed a service agreement with Honey Bees 911, in which case, the rights, permissions, and terms you have with your company and Honey Bees 911 will prevail.
    • In the event that you wish to completely remove company information and/or personal information from our database, you are responsible for notifying Honey Bees 911 in writing informing us of your intent to remove your requested information from our database.
      • Honey Bees 911 maintains the right to implement an account verification process to confirm that you are the owner of the respective account.
      • Upon receipt of your notice, Honey Bees 911 will delete and eliminate your information within a reasonable amount of time.
      • Honey Bees 911 is not responsible for company and personal account information that may have been collected and stored by a third party user of Honey Bees 911 or visitor to www.HoneyBees911.com.
    • The provisions of paragraphs 1 (Use of the Service), 2 (Third Party Rights), 5 (Indemnification), 7 (Copyright, Licenses and Idea Submissions), and 8 (Miscellaneous) shall survive any termination of this Agreement, unless any of the Terms differ in an Agreement executed with Honey Bees 911, in which case, the terms contained within the Agreement will prevail.
